Privacy Policy

We are very pleased about your interest in our company. Data protection has a particularly high priority for the management of Authentic Klein GmbH. The use of the websites of Authentic Klein GmbH is generally possible without providing any personal data. However, if a data subject wishes to use special services offered by our company through our website, the processing of personal data may become necessary. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the consent of the data subject.

The processing of personal data, such as the name, address, email address, or telephone number of a data subject, is always carried out in accordance with the General Data Protection Regulation and in compliance with the country-specific data protection regulations applicable to Authentic Klein GmbH. Through this Privacy Policy, our company would like to inform the public about the nature, scope, and purpose of the personal data we collect, use, and process. Furthermore, this Privacy Policy informs data subjects about the rights to which they are entitled.

As the controller responsible for processing, Authentic Klein GmbH has implemented numerous technical and organizational measures to ensure the most complete protection possible for personal data processed through this website. Nevertheless, internet-based data transmissions may generally have security vulnerabilities, meaning that absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us by alternative means, for example by telephone.

  1. Definitions

The Privacy Policy of Authentic Klein GmbH is based on the terms used by the European legislator when adopting the General Data Protection Regulation (GDPR). Our Privacy Policy is intended to be easy to read and understand for the public, as well as for our customers and business partners. To ensure this, we would like to explain the terminology used in advance.

In this Privacy Policy, we use, among others, the following terms:

a) Personal Data

Personal data means any information relating to an identified or identifiable natural person, hereinafter referred to as the “data subject.” An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more specific factors relating to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

b) Data Subject

A data subject is any identified or identifiable natural person whose personal data is processed by the controller responsible for processing.

c) Processing

Processing means any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment or combination, restriction, erasure, or destruction.

d) Restriction of Processing

Restriction of processing means the marking of stored personal data with the aim of limiting its future processing.

e) Profiling

Profiling means any form of automated processing of personal data consisting of the use of such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person’s work performance, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.

f) Pseudonymization

Pseudonymization means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures ensuring that the personal data is not attributed to an identified or identifiable natural person.

g) Controller or Controller Responsible for Processing

Controller or controller responsible for processing means the natural or legal person, public authority, agency, or other body that, alone or jointly with others, determines the purposes and means of processing personal data. Where the purposes and means of such processing are determined by Union law or Member State law, the controller or the specific criteria for its nomination may be provided for by Union law or Member State law.

h) Processor

Processor means a natural or legal person, public authority, agency, or other body that processes personal data on behalf of the controller.

i) Recipient

Recipient means a natural or legal person, public authority, agency, or other body to which personal data is disclosed, whether a third party or not. However, public authorities that may receive personal data in the framework of a particular inquiry in accordance with Union law or Member State law shall not be regarded as recipients.

j) Third Party

Third party means a natural or legal person, public authority, agency, or body other than the data subject, the controller, the processor, and persons who, under the direct authority of the controller or processor, are authorized to process personal data.

k) Consent

Consent means any freely given, specific, informed, and unambiguous indication of the data subject’s wishes, in the form of a statement or other clear affirmative action, by which the data subject signifies agreement to the processing of personal data relating to them.

  1. Name and Address of the Controller Responsible for Processing

  1. Cookies

The websites of Authentic Klein GmbH use cookies. Cookies are text files that are stored on a computer system through an internet browser.

Many websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a string of characters through which websites and servers can be assigned to the specific internet browser in which the cookie was stored. This allows visited websites and servers to distinguish the individual browser of the data subject from other internet browsers that contain different cookies. A specific internet browser can be recognized and identified using the unique cookie ID.

Through the use of cookies, Authentic Klein GmbH can provide users of this website with more user-friendly services that would not be possible without the setting of cookies.

Using a cookie, the information and offers on our website can be optimized for the user. Cookies allow us, as already mentioned, to recognize users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, a user of a website that uses cookies does not have to re-enter their login details every time they visit the website, because this is handled by the website and the cookie stored on the user’s computer system. Another example is the cookie of a shopping cart in an online shop. The online shop remembers the items that a customer has placed in the virtual shopping cart via a cookie.

The data subject may prevent the setting of cookies by our website at any time by means of a corresponding setting in the internet browser used, and may thereby permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time via an internet browser or other software programs. This is possible in all common internet browsers. If the data subject disables the setting of cookies in the internet browser used, not all functions of our website may be fully usable.

  1. Collection of General Data and Information

The website of Authentic Klein GmbH collects a series of general data and information each time the website is accessed by a data subject or an automated system. This general data and information is stored in the server log files. The following may be collected:

  1. Browser types and versions used

  2. The operating system used by the accessing system

  3. The website from which an accessing system reaches our website, known as the referrer

  4. The subpages accessed on our website by an accessing system

  5. The date and time of access to the website

  6. An internet protocol address, also known as an IP address

  7. The internet service provider of the accessing system

  8. Other similar data and information used for danger prevention in the event of attacks on our information technology systems

When using this general data and information, Authentic Klein GmbH does not draw any conclusions about the data subject. Rather, this information is required in order to:

  1. Deliver the contents of our website correctly

  2. Optimize the contents of our website and the advertising for it

  3. Ensure the long-term functionality of our information technology systems and the technology of our website

  4. Provide law enforcement authorities with the information necessary for prosecution in the event of a cyberattack

This anonymously collected data and information is therefore evaluated by Authentic Klein GmbH statistically and with the aim of increasing data protection and data security in our company, in order to ultimately ensure an optimal level of protection for the personal data we process. The anonymous data from the server log files is stored separately from all personal data provided by a data subject.

  1. Registration on Our Website

The data subject has the possibility to register on the website of the controller by providing personal data. The personal data transmitted to the controller is determined by the respective input form used for registration. The personal data entered by the data subject is collected and stored exclusively for internal use by the controller and for the controller’s own purposes. The controller may arrange for the transfer of such data to one or more processors, for example a parcel service provider, who will also use the personal data exclusively for internal use attributable to the controller.

By registering on the website of the controller, the IP address assigned by the data subject’s internet service provider, as well as the date and time of registration, are also stored. This data is stored because it is the only way to prevent misuse of our services and, if necessary, to enable the investigation of criminal offenses. In this respect, the storage of this data is necessary to protect the controller. This data is generally not passed on to third parties unless there is a legal obligation to disclose it or the disclosure serves the purpose of criminal prosecution.

The registration of the data subject, with voluntary provision of personal data, enables the controller to offer the data subject content or services that, due to their nature, can only be offered to registered users. Registered persons are free to change the personal data provided during registration at any time or to have it completely deleted from the controller’s database.

The controller shall provide any data subject, at any time upon request, with information about which personal data relating to the data subject is stored. Furthermore, the controller shall correct or delete personal data at the request or notice of the data subject, provided that no statutory retention obligations prevent this. All employees of the controller are available to the data subject as contact persons in this context.

  1. Subscription to Our Newsletter

On the website of Authentic Klein GmbH, users are given the opportunity to subscribe to our company newsletter. Which personal data is transmitted to the controller when subscribing to the newsletter is determined by the input form used for this purpose.

Authentic Klein GmbH informs its customers and business partners at regular intervals about company offers by means of a newsletter. The newsletter of our company can generally only be received by the data subject if:

  1. The data subject has a valid email address

  2. The data subject registers for newsletter delivery

For legal reasons, a confirmation email is sent using the double opt-in procedure to the email address entered by a data subject for the first time for newsletter delivery. This confirmation email is used to verify whether the owner of the email address, as the data subject, has authorized receipt of the newsletter.

When registering for the newsletter, we also store the IP address assigned by the internet service provider to the computer system used by the data subject at the time of registration, as well as the date and time of registration. The collection of this data is necessary in order to trace any possible misuse of the email address of a data subject at a later point in time and therefore serves the legal protection of the controller.

The personal data collected as part of newsletter registration is used exclusively for sending our newsletter. Furthermore, subscribers to the newsletter may be informed by email if this is necessary for the operation of the newsletter service or for a related registration, as may be the case in the event of changes to the newsletter offer or changes in technical circumstances. No personal data collected as part of the newsletter service is passed on to third parties.

The subscription to our newsletter may be terminated by the data subject at any time. The consent to the storage of personal data that the data subject has given us for newsletter delivery may be revoked at any time. For the purpose of revoking consent, a corresponding link can be found in every newsletter. Furthermore, it is possible to unsubscribe from the newsletter at any time directly on the website of the controller or to inform the controller in another way.

  1. Newsletter Tracking

The newsletters of Authentic Klein GmbH contain so-called tracking pixels. A tracking pixel is a miniature graphic embedded in emails sent in HTML format in order to enable log file recording and log file analysis. This allows a statistical evaluation of the success or failure of online marketing campaigns. Using the embedded tracking pixel, Authentic Klein GmbH can determine whether and when an email was opened by a data subject and which links contained in the email were accessed by the data subject.

Such personal data collected through tracking pixels contained in newsletters is stored and evaluated by the controller in order to optimize newsletter delivery and to better adapt the content of future newsletters to the interests of the data subject. This personal data is not passed on to third parties. Data subjects are entitled at any time to revoke the separate consent declaration given through the double opt-in procedure. After revocation, this personal data is deleted by the controller. Authentic Klein GmbH automatically regards unsubscribing from the newsletter as a revocation.

  1. Contact Possibility via the Website

Due to legal regulations, the website of Authentic Klein GmbH contains information that enables quick electronic contact with our company and direct communication with us, including a general email address. If a data subject contacts the controller by email or through a contact form, the personal data transmitted by the data subject is automatically stored.

Such personal data transmitted voluntarily by a data subject to the controller is stored for the purpose of processing the request or contacting the data subject. This personal data is not passed on to third parties.

  1. Comment Function in the Blog on the Website

Authentic Klein GmbH offers users the opportunity to leave individual comments on individual blog posts on a blog located on the website of the controller. A blog is a portal maintained on a website, usually publicly visible, in which one or more people, known as bloggers or web bloggers, can post articles or write thoughts in so-called blog posts. Blog posts can usually be commented on by third parties.

If a data subject leaves a comment in the blog published on this website, in addition to the comments left by the data subject, information about the time of comment entry and the username or pseudonym chosen by the data subject is stored and published. Furthermore, the IP address assigned by the internet service provider of the data subject is logged.

This storage of the IP address is carried out for security reasons and in the event that the data subject violates the rights of third parties or posts unlawful content through a comment. The storage of this personal data is therefore in the controller’s own interest so that the controller could, if necessary, exonerate itself in the event of a legal violation. This collected personal data is not passed on to third parties unless such disclosure is required by law or serves the legal defense of the controller.

  1. Subscription to Comments in the Blog on the Website

The comments made in the blog of Authentic Klein GmbH can generally be subscribed to by third parties. In particular, there is the possibility that a commenter may subscribe to comments following their comment on a specific blog post.

If a data subject chooses the option to subscribe to comments, the controller sends an automatic confirmation email in order to verify, using the double opt-in procedure, whether the owner of the specified email address has actually chosen this option. The option to subscribe to comments can be terminated at any time.

  1. Routine Deletion and Blocking of Personal Data

The controller processes and stores personal data of the data subject only for the period necessary to achieve the purpose of storage, or where this is provided for by the European legislator or another legislator in laws or regulations to which the controller is subject.

If the storage purpose no longer applies, or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data is routinely blocked or deleted in accordance with statutory provisions.

  1. Rights of the Data Subject

a) Right to Confirmation

Every data subject has the right granted by the European legislator to obtain confirmation from the controller as to whether personal data concerning them is being processed. If a data subject wishes to exercise this right of confirmation, they may contact an employee of the controller at any time.

b) Right of Access

Every data subject affected by the processing of personal data has the right granted by the European legislator to obtain from the controller, at any time and free of charge, information about the personal data stored about them and a copy of this information. Furthermore, the European legislator has granted the data subject access to the following information:

  • The purposes of processing

  • The categories of personal data being processed

  • The recipients or categories of recipients to whom the personal data has been or will be disclosed, in particular recipients in third countries or international organizations

  • Where possible, the planned duration for which the personal data will be stored, or, if this is not possible, the criteria used to determine that duration

  • The existence of a right to rectification or deletion of personal data concerning them, or to restriction of processing by the controller, or a right to object to such processing

  • The existence of a right to lodge a complaint with a supervisory authority

  • Where the personal data is not collected from the data subject: all available information about the origin of the data

  • The existence of automated decision-making, including profiling, pursuant to Article 22(1) and (4) GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and intended effects of such processing for the data subject

Furthermore, the data subject has a right to information as to whether personal data has been transferred to a third country or to an international organization. If this is the case, the data subject also has the right to obtain information about the appropriate safeguards relating to the transfer.

If a data subject wishes to exercise this right of access, they may contact an employee of the controller at any time.

c) Right to Rectification

Every data subject affected by the processing of personal data has the right granted by the European legislator to request the immediate correction of inaccurate personal data concerning them. Furthermore, taking into account the purposes of the processing, the data subject has the right to request completion of incomplete personal data, including by means of a supplementary statement.

If a data subject wishes to exercise this right to rectification, they may contact an employee of the controller at any time.

d) Right to Deletion / Right to Be Forgotten

Every data subject affected by the processing of personal data has the right granted by the European legislator to request from the controller that personal data concerning them be deleted immediately, provided that one of the following reasons applies and insofar as the processing is not necessary:

  • The personal data was collected or otherwise processed for purposes for which it is no longer necessary.

  • The data subject withdraws consent on which the processing was based pursuant to Article 6(1)(a) GDPR or Article 9(2)(a) GDPR, and there is no other legal basis for the processing.

  • The data subject objects to the processing pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) GDPR.

  • The personal data was processed unlawfully.

  • Deletion of the personal data is necessary to fulfill a legal obligation under Union law or Member State law to which the controller is subject.

  • The personal data was collected in relation to offered information society services pursuant to Article 8(1) GDPR.

If one of the above-mentioned reasons applies and a data subject wishes to request deletion of personal data stored by Authentic Klein GmbH, they may contact an employee of the controller at any time. The employee of Authentic Klein GmbH will arrange for the deletion request to be complied with immediately.

If the personal data has been made public by Authentic Klein GmbH and our company, as controller, is obliged pursuant to Article 17(1) GDPR to delete the personal data, Authentic Klein GmbH shall, taking into account available technology and implementation costs, take reasonable measures, including technical measures, to inform other controllers processing the published personal data that the data subject has requested the deletion by such other controllers of all links to this personal data or copies or replications of this personal data, insofar as processing is not necessary. The employee of Authentic Klein GmbH will arrange the necessary steps in each individual case.

e) Right to Restriction of Processing

Every data subject affected by the processing of personal data has the right granted by the European legislator to request from the controller the restriction of processing if one of the following conditions is met:

  • The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.

  • The processing is unlawful, and the data subject opposes deletion of the personal data and instead requests restriction of the use of the personal data.

  • The controller no longer needs the personal data for the purposes of processing, but the data subject requires it for the establishment, exercise, or defense of legal claims.

  • The data subject has objected to processing pursuant to Article 21(1) GDPR and it has not yet been determined whether the legitimate grounds of the controller override those of the data subject.

If one of the above-mentioned conditions is met and a data subject wishes to request the restriction of personal data stored by Authentic Klein GmbH, they may contact an employee of the controller at any time. The employee of Authentic Klein GmbH will arrange for the restriction of processing.

f) Right to Data Portability

Every data subject affected by the processing of personal data has the right granted by the European legislator to receive the personal data concerning them, which was provided by the data subject to a controller, in a structured, commonly used, and machine-readable format. They also have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided, provided that the processing is based on consent pursuant to Article 6(1)(a) GDPR or Article 9(2)(a) GDPR, or on a contract pursuant to Article 6(1)(b) GDPR, and the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority assigned to the controller.

Furthermore, in exercising their right to data portability pursuant to Article 20(1) GDPR, the data subject has the right to have the personal data transmitted directly from one controller to another, where technically feasible and provided that this does not adversely affect the rights and freedoms of others.

To exercise the right to data portability, the data subject may contact an employee of Authentic Klein GmbH at any time.

g) Right to Object

Every data subject affected by the processing of personal data has the right granted by the European legislator to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them that is carried out on the basis of Article 6(1)(e) or (f) GDPR. This also applies to profiling based on these provisions.

Authentic Klein GmbH shall no longer process the personal data in the event of an objection, unless we can demonstrate compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the data subject, or the processing serves the establishment, exercise, or defense of legal claims.

If Authentic Klein GmbH processes personal data for the purpose of direct advertising, the data subject has the right to object at any time to the processing of personal data for such advertising purposes. This also applies to profiling insofar as it is related to such direct advertising. If the data subject objects to Authentic Klein GmbH processing for direct advertising purposes, Authentic Klein GmbH will no longer process the personal data for these purposes.

In addition, the data subject has the right, on grounds relating to their particular situation, to object to the processing of personal data concerning them by Authentic Klein GmbH for scientific or historical research purposes or statistical purposes pursuant to Article 89(1) GDPR, unless such processing is necessary for the performance of a task carried out in the public interest.

To exercise the right to object, the data subject may directly contact any employee of Authentic Klein GmbH or another employee. The data subject is also free to exercise their right to object in connection with the use of information society services, notwithstanding Directive 2002/58/EC, by automated means using technical specifications.

h) Automated Individual Decision-Making, Including Profiling

Every data subject affected by the processing of personal data has the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them, unless the decision:

  1. Is necessary for entering into or performing a contract between the data subject and the controller

  2. Is authorized by Union law or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the rights, freedoms, and legitimate interests of the data subject

  3. Is based on the explicit consent of the data subject

If the decision is necessary for entering into or performing a contract between the data subject and the controller, or if it is based on the explicit consent of the data subject, Authentic Klein GmbH shall implement suitable measures to safeguard the rights, freedoms, and legitimate interests of the data subject, including at least the right to obtain human intervention by the controller, to express their own point of view, and to contest the decision.

If the data subject wishes to exercise rights relating to automated decisions, they may contact an employee of the controller at any time.

i) Right to Withdraw Data Protection Consent

Every data subject affected by the processing of personal data has the right granted by the European legislator to withdraw consent to the processing of personal data at any time.

If the data subject wishes to exercise their right to withdraw consent, they may contact an employee of the controller at any time.
